Eligibility for Returns: Items purchased from Gear Up Active are eligible for return within 7 days from the date of purchase. To be eligible, the item should:
• Be in its original packaging.
• Remain unused and in the same condition as received.
• Include the receipt or proof of purchase.
Exceptions: Several types of goods are exempt from being returned, including sale items, perishable goods such as food, gift cards, digital downloads, and personal care items.

Return Process: To initiate a return:
• Contact our customer service team with your order number, product details, and reason for return.
• Once confirmed, items can be mailed to our return address, which will be provided by our team. Customers will be responsible for paying return shipping costs.

SECTION 17 – REFUND POLICY

1. Shipping Coverage: Gear Up Active ships to all areas within the Philippines. For queries regarding international shipping, please reach out to our customer service.
2. Shipping Costs: The cost is determined by the size, weight, and destination of the package. The total fee will be displayed at checkout.
3. Free Shipping: We’re delighted to offer free standard shipping for retail orders exceeding ₱5,000. Wholesale orders have separate shipping rate structures based on order volume.
4. Customs & Taxes: For any orders shipped outside the Philippines, customers might incur additional charges due to customs duties and import taxes. Gear Up Active is not responsible for these additional charges or for any delays caused by customs clearance procedures.

SECTION 20 – FRAUDULENT CHARGEBACKS AND DISPUTE POLICY
Understanding Chargebacks:
A chargeback is a dispute initiated by a customer with their payment provider regarding a transaction. While chargebacks are designed to protect customers from fraudulent activity, misuse of this mechanism is considered fraudulent behavior.

1. Prohibition of Fraudulent Chargebacks:
   • Filing a false or fraudulent chargeback claim (e.g., claiming an order was not received or unauthorized despite receiving the product or service) is strictly prohibited.
   • Gear Up Active reserves the right to dispute and provide substantial evidence to contest any fraudulent chargeback claims, including but not limited to order details, delivery confirmations, IP addresses, and account activity logs.
2. Consent via 3D Secure (3DS) Payment Process:
   • All transactions on Gear Up Active are processed via the 3D Secure (3DS) payment system. This process requires the cardholder to verify the transaction using a One-Time Password (OTP) or another form of authentication.
   • By entering the OTP during checkout, the cardholder provides explicit consent to the transaction, confirming that the purchase is authorized.
   • As such, chargeback claims citing “unauthorized transactions” will not be entertained unless valid evidence of card compromise is provided by the issuing bank.
3. Consequences of Fraudulent Claims:
   • Customers found to have initiated a fraudulent chargeback claim will be subject to:
     • Permanent account suspension on Gear Up Active.
     • Legal action or involvement of law enforcement if necessary.
   • Any costs associated with handling the chargeback dispute (e.g., bank fees, administrative costs, or legal expenses) may be charged to the customer.
4. Resolution Process:
   • If you believe there was a legitimate issue with your order, we encourage you to contact our support team directly before initiating a chargeback. We are committed to resolving any concerns in a fair and transparent manner.
   • For disputed chargebacks, Gear Up Active will provide evidence of the transaction, order details, and other relevant information, to contest the claim with the payment processor.
5. Notice to Customers:
   • By making a purchase on our platform, you agree to the terms and conditions outlined herein, including this fraud and chargeback policy.
   • You acknowledge that filing a false chargeback claim not only breaches our policy but may carry legal and financial consequences.
